Terms of Service

Last updated: August 13, 2026

By downloading, installing, or using Kept (“the app”), you agree to these terms. If you don’t agree, please don’t use the app.

1. Accounts and plans

The app can be used without an account for on-device dictation. An account is required for anything that syncs — meetings, teams, and the AI features — and you are responsible for what happens under it.

There is a free tier. Paid plans, where offered, are billed through Stripe on the terms shown at purchase. If you supply your own API key for a transcription provider, that provider bills you directly and that arrangement is between you and them.

We may apply fair-use limits to the AI features, since each request costs us money to serve. Where a limit applies, the app shows you where you stand against it before you reach it.

2. Acceptable use

You agree not to:

  • Record anyone without telling them, or without their consent where the law that applies to you requires it. This is the obligation that matters most in this product and it is set out in full under Recording & consent.
  • Record conversations you are not party to, or that you have no right to record.
  • Share another person’s recording, transcript or summary beyond what they would reasonably expect.
  • Use the AI features in a way that is designed to run up cost rather than to use the product — automated bulk requests, resale of the output as a service, or sharing one account across an organisation to avoid per-seat pricing.
  • Reverse-engineer, decompile, or attempt to extract source code from the compiled app binaries.
  • Re-distribute the app, modified or unmodified, as your own product.
  • Use the app to generate content that violates applicable laws (defamation, harassment, etc.).

3. Your content

Anything you record or transcribe is yours. We claim no ownership over your audio, transcripts, notes, or anything derived from them, and we do not train models on them.

We do hold it, though, which an earlier version of these terms did not say. When you are signed in, your meetings and transcripts are stored on our servers so they can reach your other machines and the teams you share them with, and the AI features send that content to a model provider on our account. The Privacy Policy and AI processing pages say precisely what goes where.

You give us permission to store and process that content for the purpose of running the product for you, and to share it with the people and teams you direct us to. Nothing more.

3a. What the AI writes

Summaries and follow-ups are generated from a transcript, and transcripts mishear. Treat them as a draft to check, not as a record of what was agreed. Everything the AI writes is editable, and we are not responsible for decisions taken on an unchecked summary.

4. Warranty disclaimer

The app is provided “as is” and “as available” without warranties of any kind, express or implied. We don’t guarantee that transcription accuracy will meet your specific requirements, that the app will be uninterrupted, or that it will be bug-free.

5. Limitation of liability

To the maximum extent permitted by law, Kept and its authors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app, including lost data, lost profits, or business interruption.

6. Updates & changes

We may update the app and these terms at any time. Material changes to these terms will be noted with a new “last updated” date. Continued use after an update means you accept the revised terms.

7. Suspension and termination

You can stop at any time. Deleting your account from Settings ends access immediately and erases your data after 30 days; within that window you can restore it. Exporting your data works at any time, including while an account is suspended.

We may restrict or suspend an account where there is unpaid billing, abuse, a serious security concern, or a credible report that the recording features are being used unlawfully. Where we do, the app tells you what happened and how to reach us. A suspension leaves your data intact and exportable; we do not delete an account’s content as a penalty.

We can stop offering the app at any time, though we will do our best to give reasonable notice and time to export.

8. Governing law

These terms are governed by the laws of the jurisdiction where AI Thinkers is incorporated, without regard to conflict-of-laws principles.

8a. Related terms

These terms incorporate the Privacy Policy, Recording & consent, and AI processing. When any of them changes materially, the app asks you to agree again and records which version you accepted.
